Agreement
These Terms of Service (“Terms”) govern your use of ryankeiser.net and purchases of products or services offered by Ryan Keiser (“I,” “me,” or “Seller”). By using the site or completing a purchase through Stripe, you agree to these Terms.
Contact: ryan@ryankeiser.net.
Services
Offerings may include, without limitation:
- AI Implementation Kit — digital download / self-serve product
- Ecommerce Starter Kit — custom email audit and deliverables (typically 50% deposit, balance on delivery)
- Growth / retainer services — recurring monthly subscriptions
- Web design (Framer / Webflow) and related consulting
Scope, timeline, and deliverables for custom work are confirmed in writing (email, proposal, or invoice) before or at the time of deposit.
Payments
Payments are processed by Stripe. You authorize Stripe to charge the payment method you provide for the amounts shown at checkout or on an invoice (including deposits, balances, one-time fees, and subscription renewals).
Prices are in U.S. dollars unless stated otherwise. You are responsible for any applicable taxes.
Digital products
The AI Implementation Kit and similar digital goods are delivered electronically after successful payment (e.g. download link or email). Because delivery is immediate and non-tangible, all sales of digital downloads are final once access has been provided, except where required by law.
Custom projects (Starter Kit & similar)
- Work begins after the agreed deposit is received and required brand assets / access are provided.
- Deposits are applied to the project total. Unused portions may be refundable only if work has not started and cancellation is confirmed in writing; after work has started, deposits are generally non-refundable.
- The balance is due on delivery of the agreed deliverables. Delivery may be withheld until the balance is paid.
- Minor copy tweaks (typos, links) are included as described in the package. Structural changes, new flows, or major rewrites may incur additional fees.
- Compiled HTML and guides are delivered as specified. Source files (e.g. Maizzle / Vue project files) are not included unless expressly agreed in writing.
Subscriptions & retainers
Recurring plans renew automatically each billing period until canceled. You may cancel future renewals by emailing ryan@ryankeiser.net before the next billing date (or via Stripe customer portal if provided). Fees already charged for the current period are generally non-refundable unless required by law or expressly agreed.
Refunds (summary)
- Digital downloads: final after access is granted
- Deposits: non-refundable once work has started
- Retainers: cancel to stop future charges; current period generally non-refundable
If you believe a charge was made in error, contact ryan@ryankeiser.net within 14 days. Chargebacks without first contacting me may result in suspension of services.
Intellectual property
Until paid in full, deliverables remain my property. After full payment, you receive a license to use the delivered materials for your business as intended (e.g. sending emails from your ESP). Resale, redistribution, or claiming the work as a generic product for sale to third parties is not permitted without written permission.
Site content, branding, and sample portfolio materials remain my property.
Client responsibilities
You agree to provide timely access, assets, and feedback needed to complete the work; to ensure you have rights to materials you supply; and to use deliverables in compliance with ESP, advertising, and privacy laws applicable to your business.
Disclaimers
Services are provided professionally and in good faith. I do not guarantee specific revenue, open rates, deliverability outcomes, or ranking results. Email and marketing performance depend on many factors outside my control (lists, offers, ESP reputation, compliance, etc.).
To the fullest extent permitted by law, the site and services are provided “as is,” without warranties of any kind beyond those that cannot be excluded by law.
Limitation of liability
To the fullest extent permitted by law, my total liability arising out of any purchase or engagement will not exceed the amount you paid for the specific product or service giving rise to the claim in the three (3) months before the claim. I am not liable for indirect, incidental, special, consequential, or lost-profit damages.
Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Exclusive venue for disputes shall be the state or federal courts located in New York, unless applicable law requires otherwise.
Changes
I may update these Terms by posting a revised version on this page. Continued use of the site or new purchases after the “Last updated” date constitutes acceptance of the revised Terms for future transactions.
